When was the mandate that a candidate at an election should file with his nomination papers an affidavit recording the particulars of the spouse and the dependents, enforced at a General Election for the first time?

    A)  Assembly elections held in Madhya Pradesh / Chhattisgarh in December 2003

    B)  Assembly election held in Mizoram in November 2003

    C)  Assembly elections held in Himachal Pradesh in 2003

    D)  Assembly elections held in Rajasthan/Delhi in December 2003

    Correct Answer: C

    Solution :

[c] Representation of the Peoples Act 1951 mandates the declaration of assets and liabilities of the spouse of the candidate running for Parliament, failing which the candidate could be disqualified. The Supreme Court recently has ruled that no one can contest elections without making a full and honest disclosure about his/her assets and educational and criminal antecedents. Curbing the practice among candidates to leave columns demanding information blank in the affidavits filed along with nomination papers, the court authorized returning officers to demand relevant details and reject nomination papers if the details are not furnished despite reminder. Candidates left columns in affidavits blank to step around the SC's two earlier judgments which mandated a contestant to furnish details of his criminal and educational antecedents as well as assets owned by him, his spouse and children.
